This document establishes the terms and conditions under which Enigma XP, S.A. de C.V. ("Enigma Rooms") provides the contracted services and allows access to its facilities to receive the contracted service, as well as access to and use of its website www.enigmarooms.com.mx ("Site") by any interested member of the public ("Users"), and establishes the policies and rules under which the service is provided. Hereinafter, the "Terms and Conditions".
Use of the Site www.enigmarooms.com.mx
The visit and/or use of the "Site" by any "User" implies acceptance of the Terms and Conditions established herein; therefore, the User must read this document in full. If the User does not agree with the Terms and Conditions, the User may not enter the "Site" nor receive any service from "Enigma Rooms".
To access the services offered through our "Site", the User must confirm that they have read, understand, and agree to the Terms and Conditions by clicking "Accept". Otherwise, the User may not continue using the "Site" and no service may be provided.
"Enigma Rooms" reserves the right to modify the Terms and Conditions at any time, in whole or in part. We therefore suggest periodically reviewing the "Site" in order to know the current Terms and Conditions.
Users
By accessing and using the "Site", "Users" may adopt different roles, whether they only visit the "Site" without purchasing the offered services, or purchase them for themselves or for third parties on their behalf and/or with their due authorization. This includes parents or guardians in the case of minors, interested parties, etc.
Purpose of Use of the "Site"
The use of the "Site" is exclusively for "Users" to consult and obtain the information appearing on it for the purpose of contracting the services provided by "Enigma Rooms". The "Site" is for personal and non-commercial use. "Users" may receive information and reserve and contract the services provided by "Enigma Rooms" through the "Site". Once information is entered by "Users" into the system used by "Enigma Rooms", such information becomes part of the database owned by "Enigma Rooms". Any personal information provided to us is subject to our Privacy Notice.
The "Site" may not be used for any other purpose. Therefore, it is prohibited to copy, display, forward, reproduce, reuse, sell, transmit, distribute, download, license, modify, publish, or otherwise use the texts, images, data, graphics, trademarks, logos, distinctive signs and trade names, screens, articles, usernames, software contained in or used on the "Site", and other materials and information appearing on the "Site" ("Content") for public, commercial, or any other purposes other than those previously stated. The "Content" is the property of "Enigma Rooms" and its rights are protected by the Industrial Property Law and its Regulations, the Federal Copyright Law and its Regulations, and International Treaties, and infringement may result in civil and criminal liability. Under no circumstances shall it be construed that any license regarding the "Content" or any intellectual property right is granted, nor is any link to or reference to the "Site" authorized.
User Obligations
By using the "Site", "Users" accept and agree to:
- Use the "Site" in accordance with these Terms and Conditions.
- Not allow minors to access the Site unless access to and use of the "Site" is supervised by an adult User who exercises parental authority over the minor or is the minor's guardian.
- Not make improper or inappropriate use of the "Site", such as carrying out false or illegal transactions or actions that affect the image of "Enigma Rooms".
- Not copy, distribute, or disclose the personal information of any other User without their consent.
- Provide "Enigma Rooms" with true, complete, correct information that corresponds to the current situation of the "Users" in relation to the services contracted through the "Site".
Any access to the "Site", download, copy, distribution, dissemination, or any other use or possession of the "Site" Content other than that expressly permitted in this document is prohibited. Including, without limitation, data processing, screen scraping, use or application of any automated command sequence, script, macro, program, application, software, or any other similar technical device to extract, transform, copy, distribute, aggregate, cross-reference, or manipulate the "Content" or any other information or data from the "Site" is strictly prohibited.
User Communications with Enigma Rooms
Any communication sent by "Users" by email or by any other means to "Enigma Rooms" shall be at the disposal of the latter. Such communication shall not be treated as confidential, and "Enigma Rooms" assumes no obligation to disseminate, publish, reproduce, or use or not use in any other way and for any purpose the communications sent by "Users". Therefore, it shall be at the sole discretion of "Enigma Rooms" whether or not to use such communications.
If "Users" send unsolicited communications or proposals, the User accepts that "Enigma Rooms" may use the information contained in such communications or proposals for any purpose, without any obligation to remunerate or compensate "Users" for such use.
Compliance with Terms, Conditions, and Policies
"Users" agree to comply with the terms, conditions, and policies published by "Enigma Rooms" on the "Site", which shall apply to the use made of the Site and to the information provided by "Users" when entering the Site.
Reservation of Rights
The Terms and Conditions do not grant "Users" any right; they only grant permission to access and use the "Site" in accordance with this document. "Enigma Rooms" reserves the right, at its sole and absolute discretion, to revoke, suspend, and cancel access to and/or use of the "Site" by any User who, in the opinion of "Enigma Rooms", breaches the Terms and Conditions. This right may be exercised at any time and without prior notice.
Waiver
"Users" acknowledge that the use of the worldwide network known as the Internet, as well as access to and use of websites, involves an implicit risk in addition to failures of computer equipment, systems, and networks. Although "Enigma Rooms" adopts measures and procedures to guarantee the security of our "Site" and of the information provided to us through it, "Enigma Rooms" assumes no responsibility for direct or indirect damages arising from unauthorized third-party access to the personal information of such "Users". Likewise, "Enigma Rooms" does not guarantee that it will prevent such access.
"Users" accept that their access to and/or use of the "Site" is at their own risk, and that under no circumstances shall "Enigma Rooms" be responsible for any loss, damage, or harm caused, directly or indirectly, by such use of the "Site" and/or its "Content", or by their inability to use it, as well as for damages caused by downloading any audio file, data, images, materials, photographs, text, video, etc. from the "Site".
No Warranty
"Enigma Rooms" does not guarantee that the "Site" will operate free of errors and/or that its servers will be free of computer viruses or other harmful content, devices, or programs. The "Site", its "Content", and materials are provided "as is, where is" and "as and when available", without representations, warranties, or conditions, express or implied, of any kind regarding the "Site" and/or its "Content". "Enigma Rooms" does not offer any warranty regarding the accuracy, reliability, completeness, or updating of the "Content" of the "Site", and does not undertake to update it.
Limitation of Liability
"Enigma Rooms" shall in no case be liable for damages arising from the use of the "Site" and/or its "Content", including, without limitation, loss of data, information or programs, damage to computers or networks, violation of privacy and similar rights, infringement of intellectual property rights, or any other damage.
Site Availability
Although "Enigma Rooms" will make reasonable efforts for the "Content" of the "Site" to be available, this shall not at any time represent an obligation for "Enigma Rooms". "Enigma Rooms" may interrupt access to the "Site" or cancel access to its "Content" at any time, without prior notice or liability. "Enigma Rooms" shall have the authority to modify, correct, delete, and, in general, make any changes to the "Content" of the "Site" that it deems appropriate. "Users" acknowledge and accept that third parties may have access to the "Content" of the "Site" and may change or delete such "Content" without authorization from "Enigma Rooms". Therefore, "Users" accept that "Enigma Rooms" does not have absolute control over such third parties and shall in no case be liable if such changes affect the information of "Users" in any way.
Evidence
Records stored under secure conditions by "Enigma Rooms" regarding the "Site" and/or its "Content" and access to them by "Users" are recognized and accepted by such "Users" as evidence of their conduct, communications, and relationships with the "Site" and its "Content".
Indemnification
"Users" shall be responsible for indemnifying "Enigma Rooms" for damages arising from their breach of these Terms and Conditions.
Entire Agreement
These Terms and Conditions constitute the entire agreement between "Users" and "Enigma Rooms" governing access to and use of the "Site".
If any part(s) of this document is determined to be invalid or unenforceable by a competent authority, such part(s) shall be removed from this document without affecting the validity or enforceability of the remaining parts.
Currency
The costs of the services offered on the "Site" are expressed in Mexican pesos (MXP), without prejudice to the fact that they may also be expressed in United States dollars.
Copyright and Industrial Property Rights
All "Content" of the "Site" is the property of "Enigma Rooms" and is registered under copyright. Enigma Rooms®, Enigma Box®, Stress Room® are registered trademarks. All rights reserved.
Titles and Headings
Titles and headings are included only for ease of reading the Terms and Conditions, but shall not alter in any way the interpretation thereof. The text of this document shall prevail at all times.
Governing Law
"Users" agree to submit to the laws and competent courts of Mexico City to resolve any dispute with "Enigma Rooms", waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles or for any other reason.
Use of Enigma Rooms Services and Applicable Policies
Currency and Inclusion
The costs and prices of the services offered on the "Site" are expressed in Mexican pesos (MXP), without prejudice to the fact that they may also be expressed in United States dollars.
Payment of the established price grants "Users" the right to participate in the selected escape room experience, whose maximum duration is 60 (sixty) minutes. Such payment corresponds to access to the experience itself and does not constitute a guarantee of remaining in the facilities for the maximum established time.
Nature of the Experience and Duration
The services offered by "Enigma Rooms" consist of an immersive entertainment experience based on solving puzzles and challenges. The price paid by "Users" corresponds to access to and participation in such experience, and not to a fixed amount of time inside the facilities.
The maximum duration of each experience is 60 (sixty) minutes, which represents the upper time limit available to solve the escape room. However, the actual duration of the experience may be shorter than such maximum depending on the performance, abilities, and prior knowledge of "Users".
"Enigma Rooms" does not guarantee that "Users" will remain in the facilities for the full 60 (sixty) minutes, as early completion of the experience depends exclusively on the performance of the "Users" themselves. Consequently, completion of the experience in less than the established maximum time shall not give rise to any refund, reimbursement, compensation, or bonus in favor of "Users".
"Users" declare that they know and accept that, if they have previously participated in the same experience, the knowledge acquired regarding the puzzles and mechanisms of the escape room is the exclusive responsibility of the "Users" themselves. Therefore, "Enigma Rooms" assumes no obligation or liability for any reduction in game time arising from such circumstance.
Complimentary Experiences as a Courtesy
In exceptional cases and at the sole discretion of "Enigma Rooms", the company may offer "Users" access to an additional experience at no cost as a goodwill gesture, arising from a situation or inconvenience that occurred within its facilities and that "Enigma Rooms" considers appropriate to address in such manner. Such offer constitutes only a voluntary and unilateral act by "Enigma Rooms" and in no case implies acknowledgment of liability, nor the obligation to provide a refund, financial compensation, or any other additional benefit beyond that expressly granted.
Complimentary experiences offered as a courtesy shall at all times be subject to the following conditions:
- Availability: The complimentary experience shall be granted only according to the availability of schedules, rooms, and branches existing at the time the "User" wishes to use such benefit. "Enigma Rooms" does not guarantee the availability of any particular experience, schedule, or branch, so the "User" must select from the options available at the time of the visit.
- Validity: The complimentary experience benefit shall be valid for 30 (thirty) calendar days from the date on which it was granted by "Enigma Rooms". Once such period has elapsed without the "User" having used it, the benefit shall become void, without any liability for "Enigma Rooms".
- Non-transferable and non-cumulative: The complimentary experience is personal and non-transferable, may not be assigned to third parties, exchanged for cash, or accumulated with other promotions, discounts, or benefits.
- Subject to these Terms and Conditions: Access to the complimentary experience shall be fully subject to these Terms and Conditions, including, without limitation, the rules of use, access conditions, cancellation policies, and the provisions of the Nature of the Experience and Duration clause. Consequently, early completion of the complimentary experience shall not give rise to any additional compensation of any kind.
- Form of Granting: The complimentary experience benefit shall be valid only when expressly granted in writing by an authorized representative of "Enigma Rooms". Any verbal offer that is not supported by written confirmation shall not create any obligation for "Enigma Rooms".
- Number of Participants: The complimentary experience is granted for the same number of participants that made up the original group, with no possibility of increasing that number. If the "User" appears with fewer participants than originally registered, the difference shall not generate any refund, compensation, credit, or additional benefit of any kind, whether in cash, electronic transfer, or by any other means. The complimentary experience shall take place only with the participants present at the time of the visit, without exception.
Deposit and Payment Method
To use the services provided by "Enigma Rooms", it is necessary to enter the details of a credit or debit card as a guarantee. No charge will be made at the time of booking.
The full amount of the service shall be paid directly at the "Enigma Rooms" facilities where the reservation was made, before entering the selected Enigma Room®.
"Enigma Rooms" accepts the following valid payment methods: cash and MasterCard and Visa credit/debit cards.
- A cancellation charge equivalent to the price of two people in national currency (MXN Mexican pesos) shall apply to cancellations made with less than 24 hours' notice, or in case of no-show.
- No cancellation charge applies to cancellations made with 24 or more hours' notice.
"Users" accept that, in the event they dispute or do not recognize the cancellation charge, there shall be a contractual penalty of $15,000 (fifteen thousand PESOS 00/100 M.N.) in favor of "Enigma Rooms" charged to their card.
Arrival Time and Start Time
The time selected by the "User" when making a reservation corresponds to the start time of the experience, not to the arrival time at the "Enigma Rooms" facilities.
Because "Enigma Rooms" provides live entertainment with fixed and consecutive schedules, it is essential to arrive at least 15 (fifteen) minutes before the reserved time. This time is necessary to complete the registration process, payment of the service, signing of terms and conditions, and the instruction session prior to the experience.
If "Users" do not arrive at the "Enigma Rooms" facilities with the minimum advance notice stated above, "Enigma Rooms" shall not be obligated to allow access or provide the contracted service, and such failure shall be the exclusive responsibility of the "User", without giving rise to any right to refund, rescheduling, compensation, or benefit of any kind.
The time elapsed between the "User's" late arrival and the end time of the reserved schedule shall not be compensated or extended under any circumstance, as doing so would affect the schedules of other "Users" with subsequent reservations.
Cancellation Policy
To make any modification or cancellation to the services provided by "Enigma Rooms", it must be done at least twenty-four (24) hours before the start time of the game provided by "Enigma Rooms".
Accordingly, "Enigma Rooms" shall apply a cancellation charge equivalent to the price of two people in national currency (MXN Mexican pesos) for cancellations made with less than 24 hours' notice, or in case of no-show.
The only valid and acceptable ways for "Enigma Rooms" to process modifications and/or cancellations that "Users" deem appropriate are by telephone at the number published on the website of each branch.
Conditions of Use
To receive the contracted services and enter the escape rooms offered by "Enigma Rooms", "Users" must strictly comply with the following conditions of use:
1. All participants must follow the rules and instructions of "Enigma Rooms" staff. Such rules include:
- Do not enter under the influence of any type of drug or alcoholic beverage.
- Do not bring external objects into the experience, such as tools, light sources, video recorders or cameras, weapons, or any other object not provided by Enigma Rooms.
- Cell phones are prohibited.
- Follow all instructions given by Enigma Rooms staff.
- Show respectful and tolerant conduct toward all other people inside the "Enigma Rooms" facilities.
- Do not climb or get on furniture.
- Do not use excessive force or break anything.
- Do not touch objects marked with a do-not-touch sign.
- No hazardous materials, food, and/or alcoholic beverages are allowed inside the facilities.
- Smoking is not allowed inside the facilities.
- Follow and respect the instructions provided by the signs located within the experiences offered by "Enigma Rooms".
- The experience is not suitable for people with any medical condition. Therefore, access is prohibited for "Users" with any heart disease, arrhythmias, cardiovascular diseases, pacemakers, any electronic implant or prosthesis, epilepsy, neurological diseases, any recent medical history or surgery, asthma, physical ailments, pregnancy at any stage, respiratory problems, claustrophobia, mental illnesses, or any other condition that may be affected in this type of experience.
- Access is prohibited if you have any type of injury that may be aggravated inside the experiences.
- In order for you to have a truly immersive experience, all participants must be aware that there is a possibility that, during the route, they may be physically touched by Enigma Rooms staff.
- Some experiences are designed for participants to experience physically and mentally demanding situations. Participants will experience sudden sounds, flashing lights, strobe lights, low visibility, confined spaces, electric shocks, and various special effects not suitable for people with any type of medical condition.
- DO NOT TOUCH OR ASSAULT ENIGMA ROOMS STAFF FOR ANY REASON.
- You must wear the complete safety equipment at all times.
- I agree, as a User or Participant, to immediately inform any Enigma Rooms employee of any emergency that occurs within the facilities.
- I agree, as a User or Participant, not to file any type of claim, action, lawsuit, or proceeding against Enigma Rooms due to my participation in any of the services provided by the company.
- I agree, as a User or Participant, to pay Enigma Rooms for any damage to the facilities caused negligently, recklessly, or carelessly by me or my team.
- I acknowledge, as a User or Participant, that I sign this agreement and rules free from any defect of consent and under my absolute responsibility.
- I agree not to copy, reproduce, record, or use any idea or experience of Enigma Rooms for any commercial or non-commercial purpose.
- Due to the nature of the experience, the user must understand that participation in this attraction may be inherently dangerous; the activities may represent severe physical harm to "Users", and therefore "Users" access it under their strictest responsibility. By entering, you voluntarily assume the risk of personal injury, including death.
Our policies are zero tolerance: any violation of the stipulated rules shall cause the immediate termination of the experience, with no refunds.
2. "Enigma Rooms" is a game of mental skill, logic, and common sense, so the rules and instructions provided must be followed at all times.
3. "Enigma Rooms" reserves the right at all times, without any liability, to prohibit or prevent entry to its facilities to any person who, in its judgment, is not in the physical, mental, and/or health condition to comply with the instructions and rules of the games. Likewise, "Users" expressly accept that "Enigma Rooms" may request that anyone who does not comply with the rules, instructions, standards, and prohibitions applicable to the respective games leave its facilities, and may even use public force to remove such persons. In these cases, no amount shall be refunded to "Users".
4. Due to the dynamics of "Enigma Rooms" games and escape rooms, such games and escape rooms must remain closed, without this implying deprivation of liberty of any "User", since all participants may leave whenever they deem appropriate and wish to do so. For this purpose, a key, code, or emergency stop is available depending on the experience, and therefore "Users" release "Enigma Rooms" from any type of liability in this regard.
5. "Enigma Rooms" is not responsible for any type of accident or physical or moral damage that "Users" may suffer inside its facilities. Therefore, "Users" state that they reserve no action or right to claim against "Enigma Rooms" in this regard and release it from any type of liability on the matter.
6. All minors under eighteen (18) years of age who participate in the experiences within the "Enigma Rooms" facilities must be accompanied by an adult, who shall be responsible for the minor.
7. Any damage caused to the property and facilities of "Enigma Rooms" shall be covered by the "Users" who caused it, authorizing, where applicable, "Enigma Rooms" to charge the amount of such damages to the credit/debit card with which the service was paid. Likewise, "Users" may be subject to the penalties established in the applicable legal provisions in the event of damage to the "Enigma Rooms" facilities.
8. "Enigma Rooms" shall not be responsible for the loss or damage of any type of property owned or used by "Users" during the game or within the "Enigma Rooms" facilities.
Limitation of Liability
"Enigma Rooms" shall in no case be liable for damages arising from the use of its facilities and the participation of "Users" in them and in the respective escape rooms, including, without limitation, loss of objects, damage to personal property, etc.
Governing Law
"Users" agree to submit to the laws and competent courts of Mexico City to resolve any dispute with "Enigma Rooms", waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles or for any other reason.
Acceptance
By clicking the acceptance box, it is understood that "Users" fully accept the terms and conditions, policies, and rules of use, releasing "Enigma Rooms" from any type of claim in this regard.
